Did TxDOT Break the Law?

An earlier post of mine was about TxDOT altering a check of a toll road driver. Today TheNewspaper.com reports that TxDOT may have broken the law:

"...wrongful appropriation by check may be considered theft under Texas law.

"A person commits an offense if he unlawfully appropriates property with intent to deprive the owner of property," Texas Code Section 31.03 states."

I would find it impossible to believe that this was just a one-time incident performed by some innocent state employee clerk.

Anyone who has written a check to TxDOT ought to be taking a good look at this. The people who have carbons of the checks they wrote to TxCOT can then order a photocopy of the cleared check from their bank.

It seems this was something the employee or employees were instructed to do and something that happened much more than once.

It is an incident of this nature that is a godsend to those of us who would like their to be full accountability and justice rendered to the TxDOT agency.
