Governor Perry and gangsters are under a "contract" with the feds that we the people know nothing about. They are going to impose the lie, cheat and steal and destroy Texas and Texas NAFTA corridors and triple tax toll roads no matter what, under a penalty to them for breach of the "contract" that we the people know nothing about.
These thugs do not make "mistakes" and there are no "failures" and there is no incompetency when it comes to their dumping this ruination on Texas.

Yes, Governor Perry's lawyers sent the case to the wrong court, and it ate up 11 months of time. Handy if you didn't want any of the legal fireworks to go off during election time.
